These terms are an agreement between you and NewKinda LLC ("NewKinda", "we", "us") covering your use of the NEWKINDA Webtop service at webtop.net (the "Service"). By creating an account or using the Service you agree to them. If you do not agree, please do not use the Service.
Webtop is a hosted bookmark organiser. You save links as named icons arranged on a grid, optionally group them into folders, choose a background, and share a webtop with other people by link. Some features are limited to paid plans, described on our home page and in your account's Billing tab.
You keep ownership of everything you put into Webtop — your links, folder names, uploaded background images, and messages. You grant us only the permission we need to run the Service: to store your content, display it back to you, and display it to the people you choose to share it with.
You agree not to use the Service to store, share or transmit anything that:
Mature content is permitted where it is lawful, provided the webtop carrying it is flagged as mature so that other users' maturity filters can work. Deliberately publishing mature content without that flag is a breach of these terms.
Our access to your content. Marking a webtop private keeps it from other users. It does not keep it from us. Our administrators can view, and where necessary edit or remove, content in any account regardless of its privacy setting. We use that access for a short list of reasons: investigating a report or a suspected breach of these terms, helping you with a support request you have made, diagnosing a technical fault, and complying with the law. We do not browse private webtops for any other reason, we do not sell or share what is in them, and administrator access is logged. Our Privacy Policy describes how we handle what we see.
A webtop or folder you make public, or share a link to, can be viewed by anyone holding that link. Treat a share link as public. We do not review shared content before it is published, and content shared by other users is theirs, not ours.
You can report content from the menus in the app, and we act on reports at our discretion. If you believe material on the Service infringes your copyright, contact us at support@newkinda.com with enough detail to identify the material and your rights in it.
Paid plans are billed in advance on a recurring basis and renew automatically until cancelled. Prices are shown before you buy and are in US dollars, exclusive of any tax that may be added at checkout. Payments are processed by Stripe; we never see or store your card details.
Cancellation, renewal and refunds are covered in full by our Refunds & Cancellation Policy, which forms part of these terms.
Deleting an account cancels any active subscription on it automatically, and no further charges are made. This applies however the account is deleted — by you from your Account page, or by us. Cancellation by deletion is not a refund; the refund rules in the Refunds & Cancellation Policy apply to it exactly as they would to an ordinary cancellation.
We may change prices. If we change the price of a plan you are on, we will tell you by email before it takes effect, and the change will only apply from your next billing period — never retroactively. Continuing to use a paid plan after that notice is how you accept the new price; cancelling before the renewal date avoids it.
We may suspend or terminate an account that breaches these terms, that is being used unlawfully, or where required by law. Where the circumstances allow it we will tell you why and give you a chance to respond. You may stop using the Service and delete your account at any time.
If we suspend or ban an account, any subscription on it is cancelled straight away and no further charges are made — we will not keep billing a card for an account we have blocked. As a rule we also refund the unused remainder of the period you had already paid for, pro-rated by time. We may decline that refund where the account was suspended for payment fraud or for abuse of the card dispute process. Refunds go back to the original payment method through Stripe.
A suspension is not always permanent. If we lift it, your account and its contents are still there; the subscription is not automatically restarted, and you are free to subscribe again. You can contact us about a suspension at any time — our contact form stays open to suspended accounts for exactly that reason.
We work to keep Webtop available and your data intact, but the Service is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, or that it will never lose data. Webtop is a convenience for organising links — it is not a backup service, and you should not rely on it as the only copy of anything you cannot afford to lose.
To the fullest extent the law allows, NewKinda LLC is not liable for indirect, incidental or consequential damages, and our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose. Some jurisdictions do not allow these limits, in which case they apply to you only as far as that jurisdiction permits.
We may update these terms. If a change materially affects your rights we will notify account holders by email or in the app before it takes effect. The "last updated" date above always reflects the current version.
These terms are governed by the laws of the State of Vermont, United States, without regard to its conflict-of-laws rules, and the courts located in Vermont will have jurisdiction over any dispute.
